This Privacy Policy for Young Planet Enterprises Limited (“YoungPlanet”, “we”, “us”, or “our”), describes how and why we might access, collect, store, use, and/or share (“process”) your personal information when you use: (i) the website located at youngplanet.com and its subdomains (collectively, the “Website”); (ii) any mobile application(s) that YoungPlanet offers that links to or references this Privacy Policy (each, an “Application”); and (iii) the products, services, content, and other resources available on or enabled via the Website or any Application, including the free circular marketplace functionality of the Application that enables users to post Items (as defined below), discover Items, and exchange Items with other users (the “Marketplace”) and the discount offering that provides subscribed users with access to Coupon Codes (as defined below) for redemption by the Provider (as defined below) and discounted Vouchers (as defined below) available for purchase (the “Discount Offering”) (collectively, with the Application and Website, the “Service”), including when you engage with us in other related ways, including any marketing or events. Capitalised terms used but not defined in this Privacy Policy have the meaning given to them in our Terms of Use Agreement.

1. What Information Do We Collect?

Personal information you disclose to us

In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when you register on the Service, express an interest in obtaining information about us or our products and services, when you participate in activities on the Service, or otherwise when you contact us.

Personal Information Provided by You. 

The personal information that we collect when you provide it to us depends on the context of your interactions with us and the Service, the choices you make, and the products, features, and functionalities you use. Such personal information may include:

  • names;

  • email addresses;

  • mailing addresses;

  • usernames;

  • passwords;

  • contact preferences;

  • contact or authentication data;

  • billing addresses;

  • debit/credit card numbers;

  • parental status; and

  • gender.

Payment Data. 

When necessary, and with your consent or as otherwise permitted by applicable law, we and our payment processors process financial data to facilitate payments for purchases on the Service. We use different processors for processing payment data depending on what you're purchasing:

  • Vouchers. If you purchase a voucher, your payment is processed by Stripe Payments Europe, Limited, who collect data necessary to process the transaction, such as your payment instrument number and associated security code. Stripe's Privacy Policy is available here: https://stripe.com/privacy.

  • Subscriptions. If you purchase a subscription, your payment is handled directly by the Apple App Store or Google Play Store, depending on your device. We never receive or store your card details. We use RevenueCat to manage subscription status and entitlements; RevenueCat receives transaction and subscription data (such as purchase date, renewal status, and product identifier) from Apple/Google on our behalf, but not your payment instrument number. External Account Login Data. 

The Service may offer you the ability to register and log in using your account details for a third party service (like your Facebook, Google, or iCloud logins) (such service a “Third-Party Login Service” and your account thereon, your “External Account”). Where you choose to do this, we will receive certain profile information about you from the provider of Third-Paty Service. The profile information we receive may vary depending on the provider concerned, but will often include your name, email address, and profile picture, and may include other information you choose to make public on such Third-Party Login Service. We will use the information we receive only for the purposes that are described in this Privacy Policy or that are otherwise made clear to you on the Service. Please note that we do not control, and are not responsible for, other uses of your personal information by the provider of a Third-Party Login Service. We recommend that you review their privacy policy to understand how they collect, use, and share your personal information, and how you can set your privacy preferences on their sites and apps.

Application Data. 

If you use the Application, we also may collect the following information if you choose to provide us with access or permission.

  • Geolocation Information. We may request access or permission to track location-based information from your mobile device, either continuously or while you are using the Application, to provide certain location-based services. We collect location data such as information about your device's location, which can be either precise or imprecise. How much information we collect depends on the type and settings of the device you use to access the Service. For example, we may use GPS and other technologies to collect geolocation data that tells us your current location (based on your IP address). You can opt out of allowing us to collect this information either by refusing access to the information or by disabling access to location information in your device’s settings. However, if you choose to opt out, you may not be able to use certain aspects of the Service.

  • Mobile Device Access. We may request access or permission to certain features from your mobile device, including your mobile device's camera, storage, and other features. If you wish to change our access or permissions, you may do so in your device's settings.

  • Push Notifications. We may request to send you push notifications regarding your account or certain features of the application(s). If you wish to opt out from receiving these types of communications, you may turn them off in your device's settings.

This information is primarily needed to maintain the security and operation of our application(s), for troubleshooting, and for our internal analytics and reporting purposes.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.

Information automatically collected

In Short: Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit the Service.

We automatically collect certain information when you visit, use, or navigate the Service. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use the Service, and other technical information. This information is primarily needed to maintain the security and operation of the Service, and for our internal analytics and reporting purposes.

Like many businesses, we also collect information through cookies and similar technologies.

The information we collect includes the following.

  • Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information that our servers automatically collect when you access or use the Service and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Service (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called 'crash dumps'), and hardware settings).

  • Device Data. We collect device data such as information about your computer, phone, tablet, or other device that you use to access the Service. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information, model, manufacturer, operating system, version information and system configuration information.

  • Google API. Our use of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.

Information we receive from third parties

In Short: We receive certain information about you from third parties, including social media platforms, our payment and subscription partners, location service providers, and affiliate networks we work with.

In addition to the information you provide to us directly, we receive personal information about you from the following third parties.

Third party login providers. If you choose to register or log in using a Third Party Login Service (such as Facebook, Google, or iCloud), the provider of that service will share certain profile information with us, such as your name, email address, and profile picture. See ‘External Account Login Data.’ above for more detail.

Payment and subscription platforms. If you purchase a subscription through the Apple App Store or Google Play Store, Apple or Google shares transaction and subscription data (such as purchase date, renewal status, and product identifier) with our subscription management provider, RevenueCat, on our behalf. We do not receive your payment instrument details from this process. See ‘Payment Data.’ above for more detail.

Location service providers. When you use location-based features of the Application, we receive location information generated using Google Maps Platform APIs, which estimate your location using GPS, Wi-Fi, and cell tower data. See ‘When we use Google Maps Platform APIs.’ below for more detail.

Affiliate networks. When you redeem a Coupon Code or Voucher through the Service, you may be redirected through one or more affiliate networks before reaching the Provider's site. Those affiliate networks share limited data back with us, such as confirmation that a click or purchase originated from the Service, so that we can verify and receive commission. This does not include your payment details.

2. How Do We Process Your Information?

In Short: We process your information to provide, improve, and administer the Service, communicate with you, for security and fraud prevention, and to comply with law. We may also process your information for other purposes with your consent.

We process your personal information for a variety of reasons, depending on how you interact with the Service, including to:

  • facilitate account creation and authentication and otherwise manage user accounts so you can create and log in to your account, as well as keep your account in working order;

  • deliver and operate the Service;

  • respond to your inquiries and solve any potential issues you might have with the requested service;

  • send you details about our products and services, changes to our terms and policies, and other similar information;

  • enable user to user communication;

  • process sales and purchases, and fulfil and manage your orders, including processing payments for subscriptions and Vouchers, providing receipts, and handling refunds;

  • perform accounting, auditing, billing, reconciliation, and collection activities;

  • where you have consented, perform data analyses and data aggregation to understand how the Service is used;

  • monitor, diagnose, and fix errors, including recording diagnostic information when something breaks;

  • evaluate and improve the Service, our products, and your experience;

  • send you marketing and promotional communications in accordance with your preferences, and to measure whether those messages were opened or acted on;

  • apply and enforce our Terms of Use Agreement and other agreements;

  • protect the Service and the rights, property, or safety of YoungPlanet, our employees, our users, or others, including for purposes of fraud monitoring and reducing credit risk;

  • comply with industry standards and our policies;

  • request feedback or contact you about your use of the Service;

  • enable the performance of public interest research in accordance with ‘How Do We Use Your Information for Research?’ below; and

  • comply with our legal obligations, respond to legal requests, and exercise, establish, or defend our legal rights.

We may also use the information in other ways for which we provide specific notice at the time of collection.

3. How Do We Use Artificial Intelligence?

We may use third-party AI service to process content you give us in accordance in accordance with the purposes set forth in ‘How Do We Process Your Information?’ above. When we do this, the relevant content is sent to that provider, processed, and returned. Your content is not used to train the provider's models.

5. When And with Whom Do We Share Your Personal Information?

In Short: We may share information in specific situations described in this section and/or with the following categories of third parties.

Vendors, Consultants, and Other Third-Party Service Providers.

We may share your data with third-party vendors, service providers, contractors, or agents ('third parties') who perform services for us or on our behalf and require access to such information to do that work. 

The categories of third parties we may share personal information with are as follows:

  • affiliate marketing programs

  • ai platforms

  • cloud computing services

  • communication & collaboration tools

Business Transfers. 

We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

When we use Google Maps Platform APIs. 

We may share your information with certain Google Maps Platform APIs (e.g. Google Maps API, Places API). We use certain Google Maps Platform APIs to show maps on listing and location screens and to retrieve certain information when you make location-specific requests. This includes: when you identify your location when signing up for an account and other similar circumstances. Google Maps uses GPS, Wi-Fi, and cell towers to estimate your location. GPS is accurate to about 20 meters, while Wi-Fi and cell towers help improve accuracy when GPS signals are weak, like indoors. This data helps Google Maps provide your location, but it is not always perfectly precise. This is necessary for the map features of the Service to function, and information is only sent to Google Maps when a map is displayed on screen. The Google Maps Platform APIs that we use store and access information on your devices, including device identifiers and your app's bundle ID.

Affiliates. 

We may share your information with our affiliates in which case we will require those affiliates to honour this Privacy Policy. Affiliates include any parent company and any subsidiaries, joint venture partners, or other companies that we control or that are under common control with us now or in the future.

Business Partners. 

We may share your information with our business partners to offer you certain products, services, or promotions.

For Public-Interest Research.

We may share your information with researchers and organisations for the purpose of public interest research. For more information on how we use information for research, please see ‘How Do We Use Your Information for Research?’ below.

Other Users. 

When you share personal information (for example, by posting items, communicating with users, or making other content available to other users on the Service) or otherwise interact with public areas of the Service, such personal information may be viewed by all users and may be publicly made available outside the Service in perpetuity.

6. What Is Our Stance on Third-Party Websites?

In Short: We are not responsible for the safety of any information that you share with third parties that we may link to or who advertise on the Service, but are not affiliated with, the Service.

The Service may link to third-party websites, online services, or mobile applications and/or contain advertisements from third parties that are not affiliated with us and which may link to other websites, services, or applications. Accordingly, we do not make any guarantee regarding any such third parties, and we will not be liable for any loss or damage caused by the use of such third-party websites, services, or applications. The inclusion of a link towards a third-party website, service, or application does not imply an endorsement by us. We cannot guarantee the safety and privacy of data you provide to any third-party websites. Any data collected by third parties is not covered by this Privacy Policy. We are not responsible for the content or privacy and security practices and policies of any third parties, including other websites, services, or applications that may be linked to or from the Service. You should review the policies of such third parties and contact them directly to respond to your questions.

7. Do We Use Cookies and Other Tracking Technologies?

In Short: We use cookies on the website, and similar technologies in the Application, only where they are essential to the Service or where you have given us your consent.

We use cookies and similar technologies, including in the Application, local storage, device identifiers, and tracked links, to operate and improve the Service. Some of these are essential to the Service and are always active, such as those needed for payments, maps, security, and delivering notifications you've enabled. Others, such as analytics and affiliate link tracking, are only used where you have given your consent, which you can withdraw at any time in Your Preferences in the Application's Settings.

8. How Do We Use Your Information for Research?

While our primary services are commercial, we are committed to supporting advancements in scientific, social, and academic fields. Where we do so, we may share pseudonymised, de-identified, or aggregated datasets with verified academic institutions and research partners for public-interest research purposes.

  • Lawful Basis: Where we process or transfer your data for these research purposes, we rely on Legitimate Interests (Article 6(1)(f) of the UK GDPR), as balanced against your privacy expectations.

  • Safeguards: Where we share data for these purposes, we intend to apply data minimisation and pseudonymisation techniques designed to ensure you cannot be directly identified, and to require any academic partners we work with to enter into data sharing agreements prohibiting re-identification.

  • Exemption and Limitation of Rights: In accordance with Schedule 2, Part 6, Paragraph 27 of the UK Data Protection Act 2018, certain data subject rights (such as your right to access, rectification, restriction of processing, and objection) may be limited, but only to the extent that, and for as long as, complying with your request would prevent or seriously impair our ability to achieve the relevant research purposes. These limitations do not apply once that research has concluded or the results have been published in a form that does not identify you.

9. Is Your Information Transferred Internationally?

In Short: We may transfer, store, and process your information in countries other than your own.

Our servers are located in the United Kingdom. Regardless of your location, please be aware that your information may be transferred to, stored by, and processed by us in our facilities and in the facilities of the third parties with whom we may share your personal information (see ‘When And with Whom Do We Share Your Personal Information?’ above), including facilities in the United States, and other countries.

These countries may not necessarily have data protection laws or other similar laws as comprehensive as those in the United Kingdom. However, we will take all necessary measures to protect your personal information in accordance with this Privacy Policy and applicable law.

UK International Data Transfer Agreement (IDTA) and the UK Addendum to the European Commission's Standard Contractual Clauses:

Where we transfer personal information subject to the UK GDPR to countries outside the UK, we rely on the UK International Data Transfer Agreement (IDTA) or the UK Addendum to the European Commission's Standard Contractual Clauses, as appropriate. Where we transfer personal information subject to the EU GDPR (for example, information relating to legacy users who registered with us while the Service was available in the EU) to countries outside the EEA, we rely on the European Commission's Standard Contractual Clauses. Copies of these mechanisms can be provided upon request.

10. How Long Do We Keep Your Information?

In Short: We keep your information for as long as necessary to fulfil the purposes outlined in this Privacy Policy unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by law.

As a general rule, we retain personal information associated with your account for no longer than twenty-four (24) months after your account is terminated, save for the following categories, which we retain for longer where necessary:

Financial and transaction records (such as subscription payments, Voucher purchases, and refunds), which we retain for six (6) years to comply with UK tax and accounting obligations;

Records relating to fraud prevention or unresolved disputes, which we retain for as long as necessary to investigate and resolve the relevant matter;

Affiliate commission and attribution records, which we retain for as long as necessary to verify and reconcile commissions with our affiliate partners; and

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymise it, or, if this is not possible (for example, because your personal information has been stored in backup archives), we will securely store it and isolate it from further processing until deletion is possible.

11. How Do We Keep Your Information Safe?

In Short: We aim to protect your personal information through a system of organisational and technical security measures.

We have implemented appropriate and reasonable technical and organisational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorised third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from the Service is at your own risk. You should only access the Service within a secure environment.

12. Do We Collect Information from Minors?

In Short: We do not knowingly collect data from or market to children under 18 years of age.

We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. The Service is intended for use by adults only, and by using the Service, you represent that you are at least 18 years of age. If we learn that personal information from users under 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. 13. What Are Your Privacy Rights?

In Short: The Service currently only operates in the United Kingdom. If you are a legacy user who registered with us while the Service was previously available in certain EU jurisdictions, you continue to have rights under the EU GDPR in addition to the UK GDPR, for as long as we hold your personal information.

You have certain rights under the UK GDPR and Data Protection Act 2018, and, if applicable to you, the EU GDPR. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; (iv) if applicable, to data portability; and (v) not to be subject to automated decision-making. In certain circumstances, you may also have the right to object to the processing of your personal information. You can make such a request by contacting us using the contact details provided in the section ‘How Can You Contact Us About This Notice?' below.

If you are located in the UK and are unhappy with how we have handled your personal information, you can make a complaint directly to us, and you also have the right to complain to the Information Commissioner's Office (ICO), the UK supervisory authority:

Withdrawing your consent.

If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us by using the contact details provided in the section 'How Can You Contact Us About This Notice?' below or, for analytics and affiliate link tracking, by changing your choice in Your Preferences in the Application's Settings.

However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

Opting out of marketing and promotional communications. 

You have the right to object to us processing your personal information for direct marketing purposes at any time, and we will stop such processing upon your request, without needing to assess any grounds for the objection. You can exercise this right by clicking on the unsubscribe link in the emails that we send, replying 'STOP' or 'UNSUBSCRIBE' to the SMS messages that we send, or by contacting us using the details provided in the section ‘How Can You Contact Us About This Notice?' below. You will then be removed from the marketing lists. However, we may still communicate with you, for example, to send you service-related messages that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes.

Account Information.

If you would at any time like to review or change the information in your account or terminate your account, you can log in to your account settings and update your user account.

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files as described in ‘How Can You Contact Us About This Notice?', to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements.

14. Controls For Do-Not-Track Features

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ('DNT') feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognising and implementing DNT signals has been finalised. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy.

15. Do We Make Updates to This Notice?

In Short: Yes, we will update this notice as necessary to stay compliant with relevant laws.

We may update this Privacy Policy from time to time. The updated version will be indicated by an updated 'Revised' date at the top of this Privacy Policy.
